Terms & Conditions

These terms apply to the paid subscription meteo365.es Premium. Free use of meteo365.es is not affected.

§ 1 Scope & provider

These Terms & Conditions (hereinafter “Terms”) govern the paid subscription “meteo365.es Premium” between you as a consumer and the provider:

These Terms do not apply to the ad-funded free use of the website; they concern only the paid Premium subscription. We do not accept differing terms unless we have expressly agreed to their application.

§ 2 Services

meteo365.es is available in a free, ad-funded version. Compared with the free version, the Premium subscription in particular offers:

The range of features may evolve; individual features marked “coming soon” are added gradually. The essential, permanently assured core of the service is ad-free use. The weather information is for informational purposes only and does not constitute an official warning.

§ 3 Registration & conclusion of contract

A subscription requires an account. Sign-in is passwordless via an email sign-in link or a supported sign-in service. Only your email address is stored as the account identifier.

By selecting a plan and completing the payment process via our payment provider, you make a binding offer to conclude the subscription. The contract is concluded once we confirm it or access is unlocked. You receive confirmation of the conclusion by email. The contract language is English.

§ 4 Prices & payment

All prices are final prices including any applicable statutory VAT.

Payment processing: Payment is processed via our payment provider Stripe. Card and payment data are processed by Stripe; we do not store full payment data. The payment provider’s terms additionally apply.

§ 5 Term, renewal & cancellation

Monthly plan

The monthly plan has a term of one month and renews automatically for one further month unless cancelled. It can be cancelled at any time to the end of the current billing month.

Yearly plan

The yearly plan has an initial term of 12 months. After the initial term it renews automatically for an indefinite period and can then be cancelled at any time with one month’s notice. There is no automatic further annual renewal.

Cancellation

You can cancel at any time without giving reasons — with a few clicks in your account under “Manage subscription” (customer portal). Cancellation takes effect at the end of the paid period; until then Premium access remains. Amounts already paid for the current period are not refunded pro rata, without prejudice to the right of withdrawal (§ 6) and any goodwill.

§ 6 Right of withdrawal for consumers

Withdrawal instructions

Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (MAWE MEDIAONLINE, S.L.U., Apartado de Correos 14.007, 29080 Málaga, Spain, contact@meteo365.es) of your decision to withdraw from this contract by an unequivocal statement (e.g. by email). You may use the model withdrawal form below, but this is not obligatory. To meet the withdrawal deadline it is sufficient to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal. If you withdraw from this contract, we will reimburse all payments received from you without undue delay and at the latest within fourteen days from the day on which we are informed of your withdrawal. We will use the same means of payment you used for the original transaction; in no event will you be charged any fees for this reimbursement.

Note on digital services: if you expressly request the service to begin during the withdrawal period, you must pay us a reasonable amount for the service provided up to withdrawal.

As a goodwill gesture we will also refund, on request, outside the statutory right of withdrawal if you are not satisfied shortly after subscribing — just get in touch at contact@meteo365.es.

§ 7 Availability, warranty & liability

We strive for the most uninterrupted availability of the service possible, but do not owe any particular availability rate. Maintenance, technical faults or force majeure may lead to temporary restrictions.

Weather is a complex, changeable process; the information provided is not a guarantee. Statutory warranty rights apply. Our liability for slightly negligent breaches of duty is excluded, unless essential contractual obligations are affected or damage results from injury to life, body or health; liability for intent and gross negligence and under mandatory statutory provisions remains unaffected.

§ 8 Changes to terms and prices

We may change these Terms and the prices with effect for the future, provided there is a valid reason (e.g. changed costs or legal situation). We will inform you of changes at least 30 days before they take effect in text form (e.g. by email). If you do not object by the effective date, or if you cancel, the changes are deemed accepted; we point out this consequence separately in the notice. Otherwise you may cancel before they take effect.

§ 9 Data protection

For the subscription we process in particular your email address (account identifier), your entitlement status (subscription active/inactive) and payment-related identifiers of our payment provider. Full payment data are processed by Stripe, not by us. For sign-in we set a technically necessary session cookie. Details are in our Privacy Policy.

§ 10 Dispute resolution, law & final provisions

We are neither obliged nor generally willing to participate in dispute resolution proceedings before a consumer arbitration board.

Spanish law applies. Mandatory consumer-protection provisions of the state in which you have your habitual residence remain unaffected. Jurisdiction is as stated in the Legal notice, unless mandatory statutory provisions determine otherwise.

Should any provision of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
